Terms of Service

1. Agreement to Terms

By accessing or using Litmus ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all employers, users, and candidates who interact with the platform.

2. Description of Service

Litmus is a technical assessment platform that allows employers to create coding assessments, invite candidates, and evaluate their performance. Candidates complete assessments in a browser-based IDE environment. AI-assisted scoring provides hiring insights to employers.

3. Employer Accounts

To use the Service as an employer, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years old and authorized to act on behalf of your organization.

4. Candidate Assessments

Employers may invite candidates to complete assessments via unique invite links. Candidates do not need an account to participate. By submitting an assessment, a candidate consents to their code, responses, and interactions being stored and reviewed by the inviting employer and processed by our AI scoring system.

Employers are solely responsible for ensuring their use of assessment results complies with applicable employment, anti-discrimination, and data protection laws in their jurisdiction.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to reverse engineer, decompile, or extract proprietary components of the platform
  • Use automated tools, bots, or scripts to interact with the Service outside of authorized integrations
  • Share, resell, or sublicense access to the Service
  • Impersonate any person or entity or misrepresent your affiliation with any organization
  • Interfere with the security or integrity of the platform or its infrastructure

6. Intellectual Property

The Litmus platform, including its design, software, AI models, and content, is owned by Litmus and protected by applicable intellectual property laws. You retain ownership of any code or content you submit. By submitting content, you grant Litmus a limited license to process, store, and analyze it solely for providing the Service.

7. AI-Generated Insights

Scoring and insights produced by the platform are AI-assisted and provided for informational purposes only. They are not a substitute for human judgment. Litmus makes no guarantee that AI-generated scores or recommendations are accurate, unbiased, or legally compliant hiring criteria. Employers bear full responsibility for any hiring decisions made.

8. Pricing and Payments

Litmus operates on a per-assessment pricing model. Specific pricing is presented at the time of purchase. All fees are in USD and non-refundable unless otherwise stated. We reserve the right to change pricing with 30 days' notice.

9. Termination

We may suspend or terminate your account at any time if we believe you have violated these Terms. You may close your account at any time by contacting us. Upon termination, your access to the Service will cease and we may delete your data in accordance with our Privacy Policy.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Your use of the Service is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, Litmus shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid us in the 12 months prior to the claim.

12. Changes to Terms

We may update these Terms from time to time. We will notify account holders of material changes by email or via an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
